Preamble These General Terms and Conditions of Use (hereinafter referred to as "T&Cs") are intended to legally frame the terms of making the site and services available by CCEI concerning the VIGIPOOL application and to define the conditions of access and use of the services by the site user. These T&Cs are accessible on the CCEI website under the "T&Cs" section. Any registration or use of the site implies the user's unreserved acceptance of these T&Cs. When creating an individual account, each user expressly accepts these T&Cs by checking the box preceding the following text: "I acknowledge that I have read and understood the T&Cs and I accept them without reservation." If the user does not accept the T&Cs, they declare that they waive access to the services offered by the site. CCEI reserves the right to unilaterally modify the content of these T&Cs at any time.
ARTICLE 1: DEFINITIONS In these General Terms and Conditions of Use, the following terms have, unless otherwise stated, the meaning given to them in this article. "Account" All IT and network resources assigned to a User who can use them only by identifying themselves on the Service with their username ("login") and password.
"User" Internet user who has subscribed to the Service for their own needs within the framework of strictly personal and non-commercial use and who uses the site: www.vigipool.com and the VIGIPOOL application.
"Content" All content published by the User within the Service (in particular all usernames, texts, images, links, etc.). This content is hosted by CCEI.
"Service" The Service includes all information provided by CCEI regarding the VIGIPOOL application to enable optimal use of connected devices. Use of the Service is subject to the User's validation of these T&Cs during their first connection.

Description of Services Provided and Site Access The website www.vigipool.com aims to provide information regarding the use of our full range of connected devices. The site owner strives to provide information on www.vigipool.com as accurately as possible. However, they cannot be held responsible for omissions, inaccuracies, and deficiencies in updates, whether caused by them or third-party partners who provide the information. All information on www.vigipool.com is given for information purposes only, is non-exhaustive, and is subject to change. It is provided subject to modifications made since it was posted online.
ARTICLE 3 – USER PROFILE
User authentication is required for all actions on the Service under the conditions defined below. The User must provide their email address. Each time the User wishes to use the Service, they must log in using the username and password they registered during their signup. The site is accessible free of charge, provided a VIGIPOOL device is purchased. The site is accessible from anywhere to any User with internet access and a BLUETOOTH connection. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are their responsibility. To access the services, the User must then log in using their username and password, which will be communicated after their registration. Any registered User may also request to unsubscribe via the dedicated page in their personal space. This will be effective within approximately 30 days. Any event due to force majeure resulting in site or server malfunction or interruption or modification for maintenance purposes does not engage the responsibility of CCEI. In such cases, the User waives any claim for compensation due to interruption or suspension of the service, even without notice. The User may contact the site via email at the editor’s address provided in ARTICLE 2.
ARTICLE 4 – USER OBLIGATIONS General Obligations
a) Technical Prerequisites To use the Service, the User must have unrestricted access to a properly configured computer and the technical knowledge to use the Service normally. They must have the necessary equipment, including a compatible computer or mobile device, a modem, or any other connection tool to access the internet. The Service is accessible from a mobile device, provided it uses a compatible operating system such as iOS or Android.
b) Account Creation and Service Activation To access and use the Service, the User must be authenticated via the registration module and choose a unique username. Furthermore, the User must be an adult individual.
ARTICLE 5 – INTELLECTUAL PROPERTY
The User grants CCEI a free, non-exclusive, worldwide, and transferable license for the duration of copyright protection, including rights of consultation, reproduction, representation, adaptation, and archiving of the Content, to make it accessible in whole or in part on the Site, regardless of the means used to access the Site (mobile devices, PC, tablet, via Wifi, 3G networks, etc.). CCEI is the owner and/or licensee of trademarks, including the VIGIPOOL trademark, names, logos, colors, graphics, or other distinctive signs, databases on its equipment, products, and services or on the elements of the Service, including those developed during these T&Cs. The User is not authorized to publish, distribute, extract, reuse, or reproduce these elements in any form (including photocopying or storing them on any electronic medium). It is stated that trademarks, logos, signs, and all site content (texts, images, sound, etc.) are protected by the Intellectual Property Code, particularly copyright. Any full or partial representation of this site by any means, without the express permission of the website operator, constitutes infringement punishable under Articles L.335-2 and following of the Intellectual Property Code. In accordance with Article L122-5 of the Intellectual Property Code, the User reproducing, copying, or publishing protected content must cite the author and source. The site owner holds the intellectual property rights or usage rights over all accessible site elements, including texts, images, graphics, logos, icons, sounds, software, etc. Any reproduction, representation, modification, publication, total or partial adaptation of site elements by any method or process is prohibited without prior written permission from CCEI at schereau@ccei.fr. Unauthorized use of the site or any of its content will be considered an infringement and prosecuted under Articles L.335-2 and following of the Intellectual Property Code. CCEI reserves the right to suspend or terminate a User's Account without notice or compensation in the event of hacking or illicit use of information circulating on the network originating from the User's Account. Any termination by CCEI will be notified by email sent to the User’s provided email address. The User may request deletion of their account by contacting a Service administrator. In the event of permanent Service discontinuation, the User will be notified by email one month before Service shutdown.
ARTICLE 6 – HYPERLINKS AND COOKIES – USE OF INFORMATION – MODIFICATION AND DELETION OF DATA
The site www.vigipool.com contains several hyperlinks to other websites (partners, information, etc.) set up with the site owner’s permission. However, the site owner does not have the ability to verify the content of sites visited via these links and therefore disclaims any responsibility for any potentially illegal content. The user is informed that during visits to the site www.vigipool.com, one or more cookies may be installed automatically on their computer, which the user expressly agrees to. A cookie is a small file that does not allow the user to be identified but records browsing data on a site. The data collected is intended to facilitate future browsing and allow various traffic metrics. By clicking on these links, the User acknowledges leaving the vigipool.com site. CCEI has no control over external pages and cannot be held responsible for their content. Browser settings allow users to be informed of the presence of cookies and to refuse them according to instructions available at: www.cnil.fr. Refusal to install a cookie may result in the inability to access certain services. The user may configure their browser as follows to refuse cookies:

The User expressly agrees that CCEI or VIGIPOOL may use their information for commercial purposes, including pop-up ads on the VIGIPOOL app, and the use of their email address for commercial prospecting. In France, personal data is protected under Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code, and the European Directive of October 24, 1995. On the website www.vigipool.com, the site owner only collects personal user information necessary for specific services and for commercial prospecting. The user provides this information knowingly, especially when they input it themselves. The obligation to provide this information is clearly stated on the site. In accordance with Articles 38 and following of Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, every user has the right to access, rectify, delete, and oppose their personal data. Data modifications or deletions typically occur within 30 days of the request. To exercise this right, the user must send a request via the website www.vigipool.com by email to: schereau@ccei.fr or by postal mail with a signed request and a copy of an identity document, specifying the address where the response should be sent, or through the contact form. No personal information from the user of www.vigipool.com is published without the user’s knowledge, nor is it exchanged, transferred, assigned, or sold on any medium to third parties. Only the hypothetical sale of www.vigipool.com and its rights would allow such information to be transferred to a potential acquirer, who would in turn be bound by the same obligations regarding data use and storage. The site www.vigipool.com complies with the General Data Protection Regulation (GDPR). Databases are protected under the provisions of the law of July 1, 1998, transposing Directive 96/9 of March 11, 1996, on the legal protection of databases. ARTICLE 7 – PERSONAL DATA – RESPONSIBILITY
User Responsibility for Personal Data The User is solely responsible for the data they provide through the Service and declares that the provided data is complete and accurate. The data collected as part of the Service is processed and used by CCEI to provide the Service and send information emails to the user. As per Law No. 78-17 of January 6, 1978, the User may access, modify, or delete their personal data at any time through the Service’s website.
Judicial Requests CCEI or VIGIPOOL may be required to disclose User data in response to legal requisitions. The information provided on vigipool.com is considered reliable but not guaranteed to be free of errors, defects, or omissions. The information is indicative, non-contractual, and subject to change. Despite regular updates, the site cannot be held liable for legal or administrative changes post-publication, nor for how users interpret or use the content. The User is responsible for keeping their password confidential. Any disclosure, in any form, is prohibited. The User assumes all risks related to the use of their login and password. The site disclaims all liability in this regard. The CCEI and Vigipool sites are not responsible for potential viruses that may infect a user’s device after visiting or downloading content from the site. If a User’s account is the source of hacking or illicit use of circulated information, or if the user provides false, incomplete, or frivolous registration information, CCEI may delete the account without notice.
ARTICLE 8 – GOVERNING LAW – COMPETENT COURTS
French law exclusively governs these T&Cs. In case of a dispute, the parties shall attempt an amicable resolution within 30 days. If no agreement is reached within this period, the competent courts shall be those of the user's domicile.
